Fiduciary Responsibiltity Is Good - When Does it Matter to Stand Up!

I've written about Fiduciary responsibility many times. I always let this responsibility take precedence. I can without a doubt see the nuance involved with the responsibility and those that do not uphold it's level of accountability.

I recently took on a land purchase with clients and we've been trying to get it done. The other side of the transaction has been amiable until this last week.

While my client still battles the bank and their requirements, we have been trying to help the seller stay in the deal. I have to say that while I can see the seller's point of view on closing this transaction....have you tried to close a land transaction lately....next to impossible.

Well, we have managed to get it done and the seller says "no way"!. We offer up our deposit "earnest money" and the seller say "no way".

My clients have made many arrangements for the land and a business transaction/business. They have much to loose.

Since the listing agent says that they won't go further and we have already suggested making the "earnest available" what is there left but for me to offer some commission in addition to the "ernest money deposit" . I offered $500 to help the seller move forward.

Now given, I pressured the Listing Agent with whether he was respresenting his seller's best interest and I also sent him an email version of post that I wrote providing a perspective on "how hard it is to close anything in this market"! I guess we can say he did not appreciate it.!

It is obvious in his response which I have to say is amazing. The listing agent came back with an Addenum releasing the ernest money deposit and instead of my offer of $500 from my commission ( which most agents wont' let you do) he wrote the addendum with $1000 coming from my commission.

Say what....this agent is being vindictive and mean. He know we won't make much money on this deal. We are doing it for our clients. It's a slam and a mean one!  I'll have to investigate whether my board thinks it is unethical. I checked with my manager this am....who has 18 years experience on the ethics committee.....his advice was close it and take him to the board for unethical behavior based on article 1 and others.

I don't know that I will proceed to do this. Bad business is bad business and better left behind. I choose to focus on more positive results in this world. But you can count on one thing....this man won't be on my "good list" and he will not be a person that I tell others to do business with. Libel...no way.....truth is always absolute and solid! Rather than making a friend in this market.....we have a business result that is less than genuine! I won't hesitate to share....it is the truth, after all!

Redding CA - Congratulations Neanie - 300,000 point of Contribution and Engagement!

It has taken me longer to get this last 100,000 point than the previous 200,000 points. I'm not sure why....I believe it is due to increased business. I began posting in September, 2007. So March 2010 marks my 2.5 year anniversary in ActiveRain. I'm not sure about the point legend and truthfully I really don't need to know where the point legend is. I know that I have grown tremendously and that I am changed by my involvement and engagement with AR. I know more about real estate and how to help my Consumer with the trending market conditions and I have built a pervasive Internet Marketing system that rocks. It is what brings me all my new business. I'm not about the details tonight only the celebration of my new achievement! I'm happy about 300,000....even though those before me are in the  700"s and 800"s....they also deserve what they have achieved.

I've found a sweet nuance of life here. Sophistication in my Industry. Knowledge and trending information that I can convey to my Consumer. I've made friends and I have celebrated life here as a person and as a Realtor. My truth and goodness always triumph! The best thing that has ever happened to me is ActiveRain. Redding CA - Mount Shasta in Summer - Day Trip to the North!

Mount Shasta

This is a favorite spot of ours. We travel up to Mount Shasta each fall to celebrate the Fall Equinox. There are only few months when Mount Shasta allows you to see the Mountain without his clothes (snow). You can still see a few patches down along the ridge and a bit lower. This is a very intimate place with the Mountain and you can feel the power of the environment. The trees are magnificent and I call them "The Soldier Forest".

Opportunity - Be an Opportunist NOT a Harbinger of Doom - Advice for Sellers Facing Hardship!

PrepareThis is rather a sobering post. It seems that I have been writing a number of sobering posts and re-blogging same.

See the Glass half Full and not half Empty. That phrase has power. I read a post the other day by Holly Lynch that was provocative. I believe that the post is spot on. We have hard times coming and it is best to prepare. This was really the jest of the post, however the author has a very persuasive writing style. I believe she wrote an exceptional post. Her post was directed at Realtors. My post is directed to the Consumer.

So let's see the Glass half Empty and explore that premise.

  • We have the Commercial Sector in trouble with foreclosures and more to come. It has the potential to hurt our local banks and even the big banks.
  • We will see a wave of foreclosures hit the market soon. The word is they have been held off the market to provide an appearance of government incentive and programs preventing foreclosures.
  • We have the 5-year option arms coming. More short sales and foreclosures in the higher price brackets.
  • The banks may have more incentive to foreclose due to the nature of how they write off foreclosures versus short sales. The short sales and loan modifications that are done are of a token nature and only a small percentage of the help that was promised but not delivered.
  • The Indymac buyout by the FDIC and the One West Bank purchase of the Indymac products astounds those of us holding out with belief in our government to help Sellers in Hardship. The scarest part of this point is that it appears to have been a premeditated plan to swindle people out of their homes and then go after them with deficiency judgments for the loss. Please follow the links on this story....it is only a point made here, however it has huge implications and ramifications.
  • Banks are not lending. All that TARP money has gone nowhere. Well, that is not quite true. It appears that the banks are just managing to give back to the government in yet another scheme of "bait and switch". Not only are banks not lending from the funds handed out with the Bailouts, they are not lending on the money the Consumer puts in their accounts. THE FLOW OF MONEY INTO THE ECONOMIC MARKET HAS STOPPED! Loans now take 60-90 days and longer for FHA, USDA and getting a land loan....forget it. Second home...no way!

Now, the Glass half Full and how can we see opportunity.

  • Prepare to lose your Home. Have a Plan B. If you are up against Indymac, you may not have a chance and you should research and learn all you can about what they are doing.
  • Research your bank and find out where they are on the list of bad banks.
  • Save your money. Downsize and prepare.
  • Think about where your money should be. The big banks are not providing you any value. Withdraw your money and talk to your local banks. See who took TARP money and who did not. You will find that many of the local banks did not take TARP money. They simply are not in on the deal with the Big Guys.
  • Don't buy a new car.
  • Don't buy that new flat screen TV.
  • Prepare for the big banks to fail.
  • Prepare for the currency to change.
  • Prepare for national disasters.
  • Prepare for 1 month (or more...do research) of food and water and temporary shelter.
  • Have things that you can barter.
  • Get out on the Internet and READ, READ, READ and READ! It is out there. What is going on is out there.
  • Visit the Project Camelot website and learn what is happening. Here is a link that is long but will provide you with an idea of what may be coming.
  • Get prepared.

So in summary, we can see the Glass half Full when we are prepared for what may come. Letting go of the habits of Consumerism that are killing our planet and withdrawing support of a government bent on breaking the working back of America, provides a power they cannot deal with. It changes the balance of power and helps to sustain the individual. Take action today and begin to prepare to live a sustainable and renewable life. When we depend on the government, we are trapped.

Each day, I take action to take my life back. I am doing all of the above and I encourage you to do the same. I believe in Freedom not slavery.

I do recommend that you own your own opinion and perspective and that you gather information from many sources. You are in a fight for survival. I wish you the best of luck. Here is review of market trending data from 2003 up to 2010. When we view the market data from a historical perspective, it can help us understand and recognize a new trend. One of stablization and modest growth will be the signs we look for. We are seeing that we have a less severe market decline in this rural area. We do seem to have dipped below 2003 prices. 2010 will be interesting to watch.

Moving Beyond the Cosmic Dance!

I am such a believer in life. I am in the process of re-watching my favorite movie of all time "Out of Africa". It is such a moving movie and I find such connection within it. Men and women and that dynamic that exists there in love and appreciation and sometimes as we know it...in resentment.

It is a bittersweet time for us....we rejoice in all of life's celebration. Having lost our heart's dearest gift recently, I find myself viewing the movie anew.

As they danced together under moonlight on their last night together....she admits that she may not have "owned a farm in Africa" and he rather admits that it may not be the truth of the matter. They helped one another see a different perspective...she that she did indeed own something and he that no one owned any thing. Through their love, they grew to know another truth.

It hit me with a sweetness that is a  life's lesson...that which we covet moves further away....it is a beautiful movie and as I appreciate it greatly each time I watch it, I appreciate the Cosmic Dance of Life. I have lost one so dear and I am made new. Loss provides a means to a new beginning. May I share this to help others. It is the Dance of the Cosmos and it helps us all move beyond and know new beginnings. I am so grateful.

I would never have been in a place where I could have understood or appreciated this subtle knowingness. A beautiful movie of universal truth.

I am not putting the video here...you must watch the movie anew to see the ending scene before Dennis leaves. It is such a perfect moment of knowingness. God bless us all in all we do!

ActiveRain....Could You Quit Making It So Hard for Me to Blog....Good Grief!

Just kiddiing....of course! I love blogging and being on ActiveRain.....but I'm so busy with my business that I don't have time to do the thing I love the most. I'm a work in progress however and taking action to correct all of this. It's fun being busy however, I hate missing what everyone is doing. So we are making new partnerships to help with the business activity while we focus on the business development. It is once again coming together and there are solutions being put in place and the hope that I will be back soon with my attention on ActiveRain and all that is going on. I just love it.

The only problem is our business keeps growing because everything I do here in the RAIN results in more business. Not a bad thing but I want to be here and blogging my little head off...it is my favorite thing. I love my ActiveRain family.....so to all the AR Staff and Members....I'm so glad to be here and it is such a pleasure!

Even Great Warriors Die In Battle

For many, 2010 will undoubtedly prove to be one of the toughest years in the mortgage industry. The underwriting guidelines still continue to change daily, government regulation and intervention is at an all-time high, legislation is being proposed to change compensation models for Loan Originators, more fraud verification policies are being put in place to protect lenders adding confusion, borrowers are forced to jump through ridiculous hoops and great mortgage professionals are exiting our industry in droves. Let me repeat that.... "Great" mortgage professionals are exiting our industry, not "Good", but "Great".

 I'm sure you know how we got where we are at, but do you really know where we are at? Everyday I speak with my friends from markets across the United States that are considering changing careers. The same questions come up, "How is it possible to create a great experience for a borrower with this environment?" I don't pretend to know the answer because, in my opinion, there isn't one.

  • Telling your borrower three months after closing they need to provide proof they've personally paid a credit card on their credit report for 12 months, showing their bank statements for the last 12 months. How and why would they have trust and confidence to refer their friends and family?
  • When you receive a loan approval with 45 prior to doc conditions, then it takes 45 minutes to explain why so much documentation is needed. How are your clients to have the trust and confidence to refer their friends and family?
  • Loan guidelines forcing Mortgage Professionals to order two appraisals on a property, after one has already been received $14,000 above selling price. How are today's clients to have trust and confidence to refer their friends and family when they feel they've been mistreated and forced to pay excessive costs?

When this happens over and over and over on every transaction, why would Real Estate Professionals continue to refer their clients? It's simple... they don't. They move on to the next Loan Officer. Your past clients don't refer you anymore. You soon realize you don't have a passion for this industry anymore and "Even Great Warriors Die In Battle."

For those that make it through this, we are the survivors, we are the fighters and we are the ones who will shape the perception of this industry so many love. Live the Dream - Carpe diem quam minime credula postero!
