Protecting Your Property Rights, Our Day on the Hill

Protecting Your Property Rights, Our Day on Capitol HillI just got back from D.C. where we were working to protect your property rights during a day on the hill, meeting with our Congressmen and Senators or their representatives.

Why? The National Real Estate Investors Association (National REIA) informed our local Triad REIA of some upcoming legislation that could be harmful to our business practices as well as to property owners across the country.

What we found out right away that amazed me is how available and open most of our legislators are to hearing from their constituents. Did you know that, with an appointment, you can see almost any of your local House Representatives or Senators? Possibly more difficult in Washington, D.C. than while they are at home in your state but, even then, if they don't have the time to speak with your personally, you can make appointments to meet with their aides.

Did you know that a representative may change their vote after hearing from as few as only two of their constituents? They, for the most part, do represent you and want to hear from you, it's just that so few of us ever express our needs and/or concerns to them directly.

So, we did. First, we met with a number of National REIA members in D.C. Because we had registered ahead of time, National REIA had scheduled appointments for us to meet with the legislators from our home states and, where possible, our own districts. National REIA members from approximately 12 different states attended, 10 members were there from North Carolina alone.

Here's the problem we went to address; HR 4173, the Wall Street Reform and Consumer Protection Act. Nice name. Consumer protection is certainly popular. But does it really protect the people it intends to?

The Senate companion bill is the Restoring American Financial Stability Act of 2010. Again, sounds great.

Now, try reading the bills. Thousands of pages, literally.

It appears that the main reason for this legislation is to regulate Wall Street and the mortgage industry from unscrupulous lending practices that have hurt the public. If you don't read the entire bill and don't read deeply, you can, mistakenly, believe that is all that is covered. But, a lot of extras are often added into bills and we all need to pay attention to ensure that our rights are, in fact, being protected.

What concerns us with these bills is that we are all caught in one big net directed at mortgage regulation. You, me, your parents, your grandparents, everyone would, upon passage of this legislation, be required to become licensed mortgage lenders if we decide to sell, through owner financing, any property we own. Suddenly, if your parents own a property free and clear and decide to let you buy it from them with monthly payments, they would need licensing as mortgage lenders and you would have to qualify for the loan just like through any other lender.

Many properties, such as mobile homes or land, don't qualify for bank financing but would now have to. Why? Because purchasing from individuals by using a note would no longer be legal. Many of today's buyers can't qualify for a traditional mortgage and count on seller's financing. This would no longer be an option.

Congressman Howard Coble immediately termed this "over-regulation" and we agree. What we need is a Senator (or multiple Senators) to stand up and confront this problem in the bill. What we discovered is that most legislators don't know everything in a bill if they weren't the ones who wrote it. Apparently, even the ones who sign off on the bills don't know everything in them because much can be added to a bill once it goes to committee.

Hence, our need to read and "inform" our representatives. Everyone we talked with about this bill seemed genuinely concerned and a bit alarmed at the harm this one section could do to the general population, the "mom's and pop's" out there who may have paid off some rental properties for their retirement and now, with the new laws, would no longer be able to sell with owner finance securing themselves income during retirement. Consensus was that this could not have been the original intention of this bill. Most termed the situation an "unintended consequence".

So now we follow-up with our legislators through emails, letters and personal appointments when they're back in our home states. The bill, as written, has already passed the House and will soon be voted on by the Senate.

It was very empowering to take a part in the system and learn that we actually do have a say and we can be heard. How this bill turns out will be worth paying attention to by all of us.

Zillow Finally Got Zinged in Colorado

My clients often go to Zillow for some idea of what their home is worth. Here is an example of why that is NOT a good idea. Thanks Cherise Selley for sharing this information. It is of value to all Consumers.

Like fellow Colorado Springs Realtors of Selley Group Real Estate, LLC, we’ve all felt great frustration regarding the enormous inaccuracies about values and inventory supply that have been reported by Zillow.com. As the consumer becomes more educated about the real estate markets, his or her expectations about negotiations regarding purchase prices also increases.

Specifically related to Zillow.com, their information has caused a lot of confusion for my relocation buyers, investors and sellers regarding the true status of listing inventory, as well as the actual values of Colorado Springs homes. Personally, as a Colorado Springs Realtor, I typically see Zillow.com downgrading home values between 11-15% of what is the actual value. Apparently, I’m not the only one who has seen this type of discrepancy associated with their statistical data.

Recently, this scenario played out furiously for the Denver Metro area. According to Becky Hurley of the Colorado Springs Business Journal, “In a head-to-head comparison, the state’s real estate community pointed out that the Metrolist, a company that collects and measures Colorado data, showed a for-sale inventory of 20,073. That was less than half the 42,000 unsold properties reported as “unsold” by Zillow.com for the year ending January 2010.”

According to Forbes’ Francesca Levy, “Forbes.com will no longer use Zillow.com’s information.” For accurate information about the Colorado Springs Real Estate market, please don’t hesitate to contact me.

Bed placement...what a difference a few feet can make

Michelle King gives a great lesson in Bed Placement. So many things go into the successful sale of a property. When you present your home in the most attractive and efficient ways, it sells itself. Pricing and marketing are important but a beautiful and rich decor do wonders. Thank you Michelle in this great example of how we can think creatively about presentation in the selling process.

Bed placement is critical to how future home buyers perceive a home. As much as possible bedding should be rich, comfortable, clean and even luxurious. Apart from the bedding and even the furniture style the placement of the bed needs to be considered. Each of these examples show what a difference simply moving the bed can make. 

 

Homeowners should think about bed placement as much for their own use as for the selling process. Space around a bed can make the room feel lighter, happier and with more breathing room...and therefore making it a much happier bedroom to live in.

 

    

 

This Master bedroom didn't look very masterly. Admitedly the bedding and furniture didn't help however the bed placement blocked off the back of the room making it feel smaller with inferior movement.

 

         

 

 

For this master bedroom the bed blocked the entrance to the room. Of course you can see we changed the bedding and painted the room but the most significant impact was made by moving the bed. Now when you walk into the room you can get right in.

       

 

Again here it is obvious the camera lense is very different from the before to the after but it also shows just how small and crampt the room was in the before. We couldn't see the floor and we literally walked right into the bed. By moving the bed to the opposite wall we gained lots of room around the bed making the room feel bigger and much more interesting to a home buyer. No-one wants a bedroom they can't fit a bed into.

 

 

        

 

Not everyone would want to have the head of the bed under a window especially if it is drafty. On the other hand the after room looks much bigger with plenty of space around the bed instead of being physically and emotionally blocked from the room. Is this only a concern in cold areas like ours here in Quebec ? When living in warmer climes is it okay to put a bed under the window ? I am wondering if having beds under windows is more of a construction issue (avoiding cold drafts) or a comfort (like feng shui inspired) issue. Any thoughts fellow home stagers ?

I do know at least one reason why so many people here in Montreal put their beds in awkward positions...many houses have the baseboard heaters or forced air vents on the same spot the bed would best be placed.  Is this is the case consider moving the heater or finding a work around when you are going to live in the house. You might as well enjoy all the square footage of the bedroom. If you haven't done it before selling your home chances are you shouldn't now. Try to find a work around and put the bed in the right place. It will make a difference.

Redding CA - Short Sale Changes - Federal Government Program - HAFA!

Redding CA - Short Sale Changes - Federal Short Sale Guidelines - HAFA - Extension of HAMP - April 5, 2010--National Association of Realtor’s Jeff Lischer, Managing Director for Regulatory Policy

Mr. Lischer (NAR) has worked hard to bring us the new Obama Treasury Departments HAFA Short Sale Program. NAR has put forth a huge effort to help agents and homeowners stream line the Short Sale process. The National Association of Realtors is our voice in D.C. NAR has kept Realtor’s in the game. NAR has been working hard with the Federal Government and the Major Lenders to come up with standard procedures for Short Sales.

HAMP - Home Affordable Modification Program,

and HAFA - Home Affordable Foreclosure Alternative

The Overview

  • Mortgage loan is a first lien mortgage originated on or before January 1, 2009
  • Mortgage is delinquent or default is reasonably foreseeable
  • The current unpaid principal balance is equal to or less than $729,750
  • The Borrower's total monthly mortgage payment exceeds 31% of the borrower's gross income

Incentives

  • Seller to receive $1,500 for relocation (latest news is that may increase to $3000)
  • Servicer to receive $1000 for approval of the short sale.
  • Servicer will also receive up to $2,000 for allowing $6,000 to the second lien with a 6% cap. No payments allowed by Borrower or Agent. 2nd cannot go after Borrower for judgment deficiency.

Participating Banks

  • Program is voluntary
  • Over 100 banks are participating with HAMP and expected to participate in HAFA
  • Bank of America
  • Wells Fargo
  • CitiMortgage
  • Chase

Standardized Forms are Required (More Complicated)

  • Servicer fills out the Short Sale Agreement
  • Sends the Short Sale Agreement to the Borrower
  • Borrower and Real Estate Agent Review
  • If Borrower and Real Estate Agent find the Short Sale Agreement Acceptable, they sign it.
  • Listing Broker not party to the Short Sale Agreement, but acknowledged as listing Broker.
  • Listing Broker acknowledged review of the Short Sale Agreement and agrees to the Short Sale Agreement Controls.
  • Listing Broker further understands that all offers will be presented with a RASS form.

Commissions

  • Currently the amount of commission is to be filled in by the Servicer.
  • NAR expects this to be changed and the 6% commission protected.

Marketing

  • Marketing Period to be 120 days.
  • If not sold within that period, Borrower and Agent to provide supporting marketing and analysis to extend.
  • Listing can be extended for up to 1 year.

Offers

  • Offers must be submitted with a RASS form.
  • Buyer's proof of ability to perform must accompany the RASS form and offer.
  • Servicer has 10 days to approve or disapprove. NAR's position on this is that the Servicers may not be able to comply with this guideline.
  • If the Servicer does disapprove the Short Sale offer, they must tell you why.
  • Closing to be a 45 day escrow.

There is an alternative to this process and it is called an Alternative RASS (more like the traditional SS process we currently do). You present the offer to the Servicer with a RASS form. You will not, however know what the bank is willing to accept.

Redding CA - Short Sale Changes - Federal Short Sale Guidelines - HAFA--The NAR video is below for you to watch. I tried to take good notes...but you should watch it for your own knowledge-base. My interpretation on these guidelines is that we will still need to used the same skill set we currently use to help the Servicer understand market value and the local landscape as to we move properties quickly.
